Warranty and Terms & Conditions of Sale

William Morris Tile, LLC is a limited liability corporation registered with the state of Oregon, producing and selling made-to-order tile in Washington County, Oregon, US.

1. Ordering

Although I may have assisted in preparation of an estimate for the amount of tile you need, actual quantities must be verified by your designer, architect, contractor, installer or equivalent. On all non-plumbing or bath accessories products, industry standard typically recommends ordering at least ten to fifteen percent (10-15%) overage, sometimes more, but this may not be true for decorative tile. I always ship a few additional accent tiles. This isn't possible for panels and murals. The additional tiles cover any chips or breakage in shipping, as well as cuts and other waste. Delivery dates are estimates only and do not represent fixed or guaranteed delivery dates. Any additions or changes to the order could delay the delivery date and may result in dye lot variation.

2. Taxes

No sales or other tax is collected. Purchasers shipping to certain areas where Seller is not required by law to collect from Purchaser may be subject to additional tax and/or duties. It is the responsibility of the Purchaser to determine and remit these taxes or other charges where required.

3. Shipping and Delivery

If your project is delayed, you may be tempted to leave the tiles in their packaging until install time. Do not do this.

Immediately upon delivery, please review the shipment for accuracy of materials ordered, including quantity, quality, and color, and for any shipping damage. Contact me immediately if any problems exist. If the package is damaged, please save the packaging and email a photo of the package and the broken tiles. I ship insured so this will all work out but photos and claims need to be submitted within five (5) days of receipt of material so that we can expedite the claims with the carrier and get things resolved in a timely manner. Any damage that is apparent upon delivery should be noted on the freight carrier delivery receipt when you sign for your tiles.

Purchaser is responsible for additional freight costs associated with shipments en route for: 1) re-consignment fees for changing delivery address; 2) re-delivery fees where failed delivery attempts occurred; 3) additional expediting and/or special delivery requirements. William Morris Tile, LLC assumes no liability for direct, indirect, special or consequential damages, lost working time, or any expenses that relate directly or indirectly to variations in delivery dates and times or in the event of a delivery being delayed, postponed or incorrect.

4. Colors

Colors as shown on the website are approximations and not guaranteed. Tile is reflective; the web, paint, and wallpaper are not. Because these are custom tiles, not mass-produced stocked tile, colors vary slightly by run and are influenced by temperature and humidity. When you buy a sample tile, I make a second tile for reference and keep it for six months. However, even with sample tiles, an exact match of an older sample tile is difficult, but it should be ball park because I am using the original design.

5. Installation

William Morris Tile does not accept responsibility or liability for installation, sealing or refinishing of any product. Installation instructions are delivered with tiles and are available for download on the website. Please ensure your installer reads these. No adjustment can be made once material has been installed.

6. Payment Terms and Pricing

All material is purchased with a minimum of 30-50% due upon placement of order, but may require up to 100% payment depending on product type and lead time. All orders must have full 100% payment prior to shipment, unless other arrangements were made when the order was placed. Credit cards are accepted via Paypal or other credit card processing service. Payment can also be made with personal check, money order, cashier’s check, traveler’s check and wire transfer. Prices I quote you will be honored for thirty (30) days unless otherwise noted, but probably longer. A deposit will lock in your price for three months, longer at my discretion, but not so long as a year. Prices are subject to change at any time without notice.

7. Returns, Change Orders, and Cancellations

All tiles are made to order: No returns will be accepted. You can cancel / change your order up to the time your tiles are made. Deposits and consultation fees are non-refundable (What is a consultation?). You can, however, apply your deposit to other tiles up to the time I start your tiles. Once I make your tiles, they're yours. If I haven't completed your tiles before the change order, you can pay for the tiles already made and make a new order, or proceed with the original order.

Full payment and shipment of tile must be made within 60 days of the initial order date, unless other arrangements are made, or where shipment cannot be made due delayed materials to make the tiles. Merchandise not shipped within 60 days of the initial order date will be kept for up to six months with a $50 storage fee per month. After 6 months, unless prior arrangements are made, the order will be considered abandoned. For our purposes, Abandoned means that you ordered tile, I made tile, but you haven't paid the balance or shipping or made arrangements with me about it. After six months, single abandoned tiles may be reborn as extra freebies in other orders, while murals are often donated to charity.

8. Replacement Tiles

Once installed, tile is pretty robust. If however, you do need replacement tiles, you can order them. There is no minimum order for replacement tiles. Depending on how much time has passed, there will be some variation. Colors may be a little different, the supplier may have changed the glaze on the blanks, or worst-case, an unusual size tile may have been discontinued. We'll come up with an answer.

9. Failures to Get Along

Once I've accepted your order, I am committed to doing my best for you. That has always worked out well so far, but should the day come when communication doesn't resolve things, any lawsuit or claim will be filed in Washington County, Oregon. Since I live and do business here, Oregon law applies to any disagreements we can't resolve with communication. Mind you, it's beautiful here, but bring your raincoat and mudboots.

I've stopped making new tile from customer-supplied tiles or designs, but should I make an exception, I want to make clear, even with custom tile, that I don't do work for hire. That means you will need to extend trust and won't be able to manage every step of the process. That shouldn't be necessary if we define the scope of what we're doing well in the beginning, even though some parts of the process are iterative. This means that I retain the copyright to any tiles I develop newly. This also means that no files or other materials used to create your tiles will be provided.

10. Limited One Year Warranty

Tile should be inspected prior to installation and any defects must be reported at that time. Installation constitutes acceptance of the product. Tiles are warranted to the original consumer for a minimum of one year, and longer at the discretion of William Morris Tile, LLC. Willful abuse and failure to care for the product as provided in the installation and care instructions that accompany your tile voids the warranty. I will replace tiles that fail due defects in material and workmanship for one (1) year from initial shipment date. Other than the costs covered by the warranty noted above, William Morris Tile is not liable for any direct or indirect costs associated with the repair or replacement of the product including removal, installation or reinstallation of the product.

Product damage caused by improper installation methods, installing in unsuitable environments, other misuse, abuse, accident, or improper maintenance is not covered by this warranty. With respect to tile and stone, variations in color, shade, flow, grain, tonality, crazing, veining, and texture are inherent characteristics thereof and are not defects. Variations in facial dimensions and thickness will be allowed as per industry standards. No warranties are made against crazing, scratching or wear due to: improper installation-including improper alteration of the surface with sealers or grout, falling objects, abuse, misuse, exposure to extreme temperatures, using improper chemicals or compounds, installation on floors or counters, foot traffic wear or other similar incidents. Although tiles may perform well in steam shower environments, I have not tested that and do not recommend or warranty decorative tiles for steam showers due to intense steam, heat and moisture and the high dependence of proper construction and installation for successful product performance.

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES, INCLUDING WITHOUT LIMIATATION, MERCHANTABLITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXCLUDED FROM THIS CONTRACT. FURTHER, SELLER DISCLAIMS ANY LIABILITY FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. This warranty gives you specific legal rights. You may also have other rights which vary from state/province to state/province. Any action for breach of this warranty must be commenced within one (1) year from the time the defect occurs or should have been discovered. Some states do not allow such a limitation on the time in which to sue, so the limitation may not apply to you.
